WHAT DOES A BACK INJURY ATTORNEY DO?

A back injury attorney does the same thing that other personal injury attorneys do when representing a client, they fight to get them the money they deserve.  Back injury lawyers use their knowledge of the law and previous cases to prove what your case is really worth to either an insurance company or a court.

Chris Parks has experience on both sides of the courtroom, representing injured people for 30 years, but also occasionally representing insurance companies.  His insider knowledge gives him an advantage by knowing how the other side thinks. Most importantly, his goal is to make your life as stress-free as possible the minute he accepts your case.  Chris deals with the insurance company of the person who is responsible for the accident and takes care of your case — while you focus on healing.

CHRIS’S APPROACH TO BACK INJURIES

The legal process involving a back injury claim begins with collecting evidence, gathering medical records and getting statements from witnesses.  Time is of the essence and Chris starts working on your case aggressively as soon as you hire him.

In most cases, a demand letter is sent to the insurance company proposing a settlement.  The demand letter highlights the fault of the parties and explains why you are entitled to be compensated.  It also outlines current and future medical expenses, lost wages, and general damages such as pain and suffering.

If both parties can not reach an agreement on the amount of a settlement, a lawsuit is filed.  After the filing of a lawsuit, the discovery process begins.  Discovery usually consists of interrogatories (which are written questions that must be answered under oath), requests for the production of documents, and depositions.  Depending on the case, there are often additional items of discovery such as expert witness depositions, and expert testing.  The goal of a lawsuit is to ultimately resolve your case for the amount it is worth.  Settlement negotiations often continue throughout the process.  However, if the case cannot be resolved, you have a right to a trial by jury and you should hire an experienced lawyer to represent you in that trial.  You should hire Chris Parks.

Economic Damages:

WHAT TO DO AFTER A BACK INJURY

  1. See a doctor and get appropriate medical treatment as soon as possible
  2. If you are injured in an accident, gather any pertinent evidence such as pictures, reports, or names and phone numbers of witnesses.
  3. If you believe you have a case, call a lawyer and discuss your claim.

-A Message from Chris Parks:

“If you are over 50, chances are you have experienced back pain — or at least know someone who deals with chronic pain.  Not only do I have friends and family with back pain, I have represented dozens of people with back injuries.  Often times these cases demand extra work in helping the client find a doctor that is close to their home and willing to treat them.  (In a lawsuit a doctor may have to testify on behalf of their patient and this makes some doctors reluctant to handle these cases.)  I have deposed dozens of doctors in cases involving back injuries.  The vocabulary in a back case is different than other injuries and it is important that the lawyer you hire understands the mechanisms of the spine and what your doctors is describing when he explains your injury and treatment to the jury.  Not only do I regularly question doctors on behalf of my own clients, I have also cross-examined them when representing the other side in back injury cases.  This has given me the chance to ‘walk a mile’ in the shoes of the other side.  It has also been an invaluable education as it has helped me represent my clients more effectively.

If you are suffering from a back injury, call around and interview a few lawyers.  Ask them how many cases they have tried, how many back injury claims they have handled themselves, and why you should hire them as opposed to someone else.  I will be happy to discuss my record in comparison with anyone.”
