Class Actions
Class actions are a special kind of lawsuit that allows multiple people
injured by the same issue to form a united front against those responsible
for their condition. Class actions are often used to face powerful
and litigious opponents, for large companies can easily dispatch their
team of lawyers to intimidate a single plaintiff, but a group of plaintiffs
is much more difficult to ignore. Common suits that are resolved
by class actions include:
- Automotive Defects
- Defective or Dangerous Drugs
- Industrial Pollutants (asbestos, chromium, silica dust, etc)
- Environmental Pollutants
- Tobacco Injuries
- Insurance Fraud
- Security Fraud
It is also important to understand the structure of class actions. In the United States, there are two types of class actions: federal and state. Federal actions usually require several criteria in order to begin litigation:
- The class must be big enough to make individual suits impractical
- The people in the class must have a common legal or factual claim
- The claims must be typical of the plaintiffs or defendants
- The representatives must protect the rights of their parties
- Common issues must be the main factor in the proceedings
- The class action will provide better resolution than individual action.
State class actions are usually much more complicated, as they can deal with individual state laws.
